Transfer On Death Deeds

A transfer on death deed is a deed that transfers real estate to another person when the owner dies. A transfer on death deed is revocable during the owner's lifetime as long as they retain the mental capacity to revoke the deed. A transfer on death deed can help a client avoid the need to probate a will if the real estate is the only asset owned by the person at the time of their death.

For a client who chooses to plan their estate with a transfer on death deed, it is still highly recommended that the client has the following other estate planning documents drafted and in place:

  • Will
  • Medical power of attorney
  • Statutory durable power of attorney
  • Declaration of guardian in the event of a person's incapacity
  • An appointment of agent to dispose of your remains
